$5.75M Construction Accident Settlement
Raphaelson & Levine recovered $5,750,000.00 for an injured construction worker who's life was permanently impacted by a fall-from-heights accident at a New York City job site.
"Howard Raphaelson and Andrew Levine were an awesome legal team that worked hard and were a tremendous support to my wife and me after my accident. The team at Raphaelson and Levine worked hard and never stopped moving forward and aggressively advocating on my behalf. I am now financially secure for the rest of my life, and that relieves a huge burden that I have had to live with since this accident. I am so happy, and I am so grateful for this awesome legal team. The award was above and beyond anything I ever expected, and they exceeded my expectations every step of the way from my first introduction until the end of the case."
Raphaelson & Levine are very proud of our work and, more importantly, so happy for our client. At the time of the construction accident, our client was working as a certified HVAC contractor.
He was working at the top of an opening that led to an underground vault that serviced HVAC systems at a New York Marina.
The accident occurred when a dangerous makeshift hoist set up at the top of the opening, collapsed while lowering an HVAC condenser down into the vault. The chain on the hoist trapped the worker's arm, and the weight of the condenser dragged him down into the opening pulling his arm from his body.
Our client underwent four surgeries for his injuries, which were diagnosed to be Brachioplexopathy, Peripheral Nerve Injury, and Complex Regional Pain Syndrome.
The mediated settlement agreement concluded following sophisticated negotiations that centered around the testimony of engineering experts, medical experts, life care plan experts and economists who projected our clients past and future economic losses but also the our clients past and future life care plan for medical costs, household services and other needs that he will have in the future as a result of this accident.
