How does New York define “wrongful death?”

According to New York legislation, N.Y. Est. Powers & Trusts Law § 5-4.1, “wrongful death” is defined as a fatality caused by "a wrongful act, neglect or default.” Unlike other types of personal injury lawsuits, wrongful death claims must be filed by a “personal representative” of the deceased estate.

Who is eligible to file a wrongful death lawsuit in Queens, NY?

New York’s wrongful death laws are unique.

In New York, a duly appointed personal representative of the deceased person’s estate brings the wrongful death lawsuit. That representative may be an executor or an administrator.

A family member may bring the action only if duly appointed as the estate’s personal representative; family relationship alone is not enough.

What is the statute of limitations for wrongful death claims in New York City?

Under EPTL § 5-4.1, a wrongful death lawsuit generally must be filed within two years of death. The estate’s representative should obtain advice promptly because exceptions and additional requirements may apply.

However, there are exceptions to the wrongful death lawsuit deadline:

• Medical-malpractice-related death: Do not assume that wrongful death has a two-and-a-half-year period measured from death. Wrongful death and any related malpractice or survival claim follow different timing rules that an attorney should assess together.
