Knee Injury Lawyer

A knee injury can have a dramatic impact on a person’s quality of life. As the largest joint in the human body, the knee’s structure is very complex. If injured in an accident, many things can go wrong, which can lead to a person needing medical treatment, physical therapy, pain medications, or surgery.

If you, or a loved one, have experienced a knee injury, you may have the grounds for a personal injury case. The caring and experienced knee injury attorneys at the Raphaelson & Levine law firm are here to support you as you recover. Contact us today for a free consultation by calling 212-268-3222.

Causes of Knee Injuries

Most knee injuries occur after being in a car accident. However, other events that can lead to severe knee injuries include slip and fall accidents, fall accidents (i.e., off a ladder or other high place), through acts of violence, and sports mishaps. Some knee injuries are minor and only require ice treatment, elevation, and rest, but other injuries can be very severe and cause a high level of pain.

Types of Knee Injuries

After an event occurs that hurts the knee, an injured person might notice pain and swelling. Pain and swelling could indicate broken bones or muscle tears. Other signs a knee injury has occurred include hearing popping noises, feeling like the knee has “locked up,” being unable to stand and support the body, or walking with a limp. Parts of the knee susceptible to injury include the patella (kneecap), femur, tibia, meniscus, tendons, and ligaments. One or more of these symptoms can point to a serious knee injury. Common knee injuries include:

Breaks or Fractures

A person who has been in a car crash may suffer breaks or fractures in their knee bone, especially the knee cap. The femur and tibia sections of the knee can also become broken or fractured.

Tendon Tears

Tendons connect muscles to bones and, if torn, can create severe pain and a feeling of being unable to walk because the body feels like it can’t hold its weight. Tendons are very susceptible to injury.

Ligament Injuries

Ligaments are the body part that holds knee joints together by attaching to bones. Injuries are usually the result of a tear.

  • Anterior Cruciate Ligament (ACL) Injury
  • Posterior Cruciate Ligament (PCL) Injury
  • Lateral Collateral Ligament (LCL) Injury
  • Medial Collateral Ligament (MCL) Injury

Ligament injuries can heal on their own, but some may require surgery. Unfortunately, other injuries might lead to deteriorating conditions that ultimately require knee replacement surgery.

Dislocations

In some knee injuries, a bone could dislocate from its original position. For instance, the patella can shift out of place, or the tibia or femur becomes misaligned.

Torn Meniscus

A knee has two menisci. These are pieces of cartilage that establish a cushion between the thighbone and the shinbone. One or both menisci are susceptible to injury in a motor vehicle accident or another event.

If an accident victim feels any pain, looseness, sprain sensations, swelling, or hears a pop, medical treatment should be gotten right away. Knee injuries often worsen when symptoms are ignored. It’s also important to obtain medical documentation in case it’s necessary for a knee injury lawsuit.

Common Types of Knee Injuries Sustained on the Job

Many workplaces have hazards one wouldn’t ordinarily think about until it happens to them or someone they know. Common work-related knee injuries include:

  • Slipping on a Wet Surface
  • Tripping Over Debris
  • Falling Down a Stairway
  • Repeated Bending
  • Heavy Lifting

Jobs involving routine or repetitive activities sometimes lead to deterioration or injury to the knee.

Compensation for Your Knee Injury

If your knee injury is the result of an accident occurring due to another person’s negligence, you may have grounds to file a personal injury lawsuit and obtain compensation for your injuries. However, you’ll also have the burden of proof to show someone else is at fault, be it an employer or the other driver in an auto accident. An accident attorney can be a strong ally to help with your case.

The amount of compensation available will depend upon a few factors in New York State, including, but not limited to, the severity of an injury or how the injury was obtained. For instance, the legal process for pursuing compensation for work-related knee injury will differ from that of an automobile accident or violent crime committed against you. A skilled personal injury lawyer can examine all the circumstances surrounding the incident and determine if there are grounds for a lawsuit and determine if a personal injury or workers' compensation claim should be filed.
