New York’s bike share program, officially named “Citi Bike,” launched in May of 2013. Within a month of the start of the program, users had logged 500,000 trips, traveling approximately 1 million miles total. The program seems simple: individual users borrow bicycles available at 600 stations around the city, paying a daily, weekly, or hourly fee to use the bikes for up to 30 or 45 minutes (with additional charges for extra minutes), and return them to any station.
Citi Bike is a privately financed venture, operated by NYC Bike Share LLC. Helmets are not required. In spite of this fact, only three minor accidents occurred within the first month of operation of the program. The easy availability of Citi Bike bicycles means in practical terms that many uninsured bicyclists will be on the streets of New York City every day. Citi Bike does not offer insurance as an option for people renting bicycles.
Because of the newness of the program, there is a shortage of precedents with regard to liability or coverage of injuries to bicyclists using Citi Bike. As injuries occur, bicyclists’ attorneys will be looking for sources of compensation such as bicyclists’ own insurance policies, NYC Bike Share LLC, and possibly the NYC Department of Transportation. Compensation may be very difficult to come by. An aggressive, knowledgeable, and accomplished personal injury law firm can be your greatest ally after a Citi Bike accidental injury or death.
